SMOKING BAN ARRIVES IN ENGLAND

After months of preparation within the licensed trade, the smoking ban has arrived in England, making it illegal to smoke in all enclosed and substantially enclosed premises.
While time will tell whether the smoking ban will have any effect on trading figures, or on public health, the smoking ban has thrown up many initial challenges for the licensed trade, including the provision of smoking areas, increased security staff, adequate signage and application of the Government’s distinction between open and ‘substantially enclosed’ areas, as set out under the guidance to the Health Act 2006.
While there have been no initial reports of non-compliance, penalties can be served for the following infractions:
For failing to display no-smoking signs, a fixed penalty notice of £200 (reduced to £150 if paid in 15 days) may be imposed on the manager of the premises (with a maximum fine of £1,000).
For failing to prevent smoking in a smoke-free place, a maximum fine of £2,500 may be imposed on whoever manages or controls the premises if prosecuted and convicted by a court.
